"Both numbers cannot be reasonable estimates of the harm the Mountain West would suffer," the complaint states, calling the attempt to collect both fees an impermissible "double-dip."
The lawsuit details numerous alleged violations of conference bylaws and Colorado nonprofit corporation law, including holding board meetings without proper seven-day notice requirements, conducting business without required three-fourths quorum, stripping voting rights from departing schools before they formally resigned, publishing revised bylaws without notice the day after departure announcements, and withholding payments to departing schools, including NCAA grants and playoff revenue.
